❌ What NOT to do if caught with marijuana
Do not offer money, favors, or material goods to the police or the Public Prosecutor in exchange for your release.
This can constitute the crime of bribery, punishable under both state and federal penal codes. Depending on the state, penalties range from six months to fourteen years in prison.Do not give in to extortion.
If pressured to hand over money, property, or favors in exchange for your release, ask your defense attorney to report it—or report it yourself during the detention control hearing before a Judge.Do not assault officers or witnesses during your arrest.
While you can defend yourself verbally, any physical aggression may constitute the crime of resistance against authorities. If the police or the Public Prosecutor use violence or mistreat you, you can file a complaint against them.Do not claim the marijuana belongs to someone else.
Out of fear, you might want to say the substance isn’t yours or that you’re holding it for a friend. This could actually make things worse, as it could be considered possession with intent to supply.
If the marijuana is truly for your personal use, you don’t need to lie.
