It depends on the precautionary measure imposed on you at the hearing:
1. If you were ordered into pretrial detention (mandatory or justified):
Yes, you will be in prison during that period (and possibly longer if it is extended or the proceedings continue).
2. If you were released with precautionary measures:
You do NOT have to be in prison. You may have been subject to:
• Periodic check-ins
• Prohibition from approaching a specific person
• Restriction from leaving the state or country
• Electronic ankle bracelet
Important strategic note
During those 3 months:
• You can present evidence
• Request investigative acts from the Public Prosecutor
• Prepare alternative resolutions (if applicable)
• Or even seek modification of the precautionary measure.
