Who Commits Cyber Crimes?
The Penal Code for the State of Sinaloa stipulates that a person commits a cyber crime if they knowingly and without right:
- Access or enter a database, computer system, or computer network with the intent to damage, execute, or alter a scheme, with the aim of defrauding or obtaining money, goods, or information.
- Intercept, interfere, receive, use, alter, damage, or destroy any software or computer program or the data contained within it, in the database, system, or network.
What Cyber Crimes Are Established in Mexican Penal Legislation?
In Mexico, there is a lag in the classification of cyber crimes compared to legal frameworks in other countries. However, here are some crimes defined in the Federal Penal Code and in the penal codes of various states:
- Disclosure of secrets and unlawful access to computer systems and equipment
- Sexual harassment
- Alteration or manipulation of electronic identification means
- Crimes against the privacy of sexual information
- Crimes related to copyright
- Phone scams
- Forgery of documents
- Pornography
- Identity theft
- Crimes equivalent to theft
